ALL SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We are not liable for:

8. Limitation of Liability

In no event shall Monex International Inc., its directors, employees, affiliates, or agents be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, arising from:

• Any transactions facilitated through the Site.

Our total liability, under any legal theory, shall not exceed $100 or the amount paid by you to the Company in the preceding 12 months.

You agree to indemnify and hold harmless Monex International Inc., its affiliates, officers, and employees from any claims, losses, or damages, including legal fees, arising out of:
